धारा 433
Procedure where Judges of Court of appeal are equally divided
When an appeal under this their opinions, shall be laid before another Judge of that Court, and that Judge, after such hearing as he thinks fit, shall deliver his opinion, and the judgment or order shall follow that opinion: Provided that if one of the Judges constituting the Bench, or, where the appeal is laid before another Judge under this section, that Judge, so requires, the appeal shall be re-heard and decided by a larger Bench of Judges.

उच्च न्यायालयों में अपीलें प्रायः दो-न्यायाधीशीय पीठों द्वारा सुनी जाती हैं, और उनके बीच असहमति होने पर मामला अन्यथा अनिर्णीत रह सकता है। यह उपबंध एक व्यावहारिक ‘टाई-ब्रेक’ तंत्र देता है ताकि न्याय अनिश्चितकाल तक विलंबित न हो, साथ ही यदि किसी न्यायाधीश को लगे कि विभाजन गहन विचार माँगता है तो बड़े पीठ के समक्ष विस्तृत सुनवाई का विकल्प भी सुरक्षित रखता है। यह पहले के दंड प्रक्रिया संहिता की धारा 392 के समान है।
