Power to issue commission for examination of witness in prison
The provisions of this Chapter shall be without prejudice to the power of the Court to issue, under section 319, a commission for the examination, as a witness, of any person confined or detained in a prison; and the provisions of Part B of Chapter XXV shall apply in relation to the examination on commission of any such person in the prison as they apply in relation to the examination on commission of any other person. कैदी को अदालत तक ले जाना सुरक्षा जोखिम और व्यवस्थागत लागतें पैदा करता है। यह प्रावधान स्पष्ट करता है कि इसके विकल्प के रूप में अदालतें प्रचलित ‘कमीशन’ तंत्र का उपयोग कर सकती हैं—नामित व्यक्ति को जेल भेजकर कैदी का बयान वहीं रिकॉर्ड कराया जा सकता है—और इसके लिए वही प्रक्रिया-सुरक्षाएँ लागू होंगी जो किसी अन्य गवाह का साक्ष्य कमीशन पर लेते समय लागू होती हैं।
