कलम 143
Trafficking of person
(1) Whoever, for the purpose of exploitation recruits, transports, harbours, transfers, or receives a person or persons, by—
(a) using threats; or
(b) using force, or any other form of coercion; or
(c) by abduction; or
(d) by practising fraud, or deception; or
(e) by abuse of power; or
(f) by inducement, including the giving or receiving of payments or benefits, in order to achieve the consent of any person having control over the person recruited, transported, harboured, transferred or received, commits the offence of trafficking. Explanation 1.—The expression “exploitation” shall include any act of physical exploitation or any form of sexual exploitation, slavery or practices similar to slavery, servitude, beggary or forced removal of organs. Explanation 2.—The consent of the victim is immaterial in determination of the offence of trafficking.
(2) Whoever commits the offence of trafficking shall be punished with rigorous imprisonment for a term which shall not be less than seven years, but which may extend to ten years, and shall also be liable to fine.
(3) Where the offence involves the trafficking of more than one person, it shall be punishable with rigorous imprisonment for a term which shall not be less than ten years but which may extend to imprisonment for life, and shall also be liable to fine.
(4) Where the offence involves the trafficking of a child, it shall be punishable with rigorous imprisonment for a term which shall not be less than ten years, but which may extend to imprisonment for life, and shall also be liable to fine.
(5) Where the offence involves the trafficking of more than one child, it shall be punishable with rigorous imprisonment for a term which shall not be less than fourteen years, but which may extend to imprisonment for life, and shall also be liable to fine.
(6) If a person is convicted of the offence of trafficking of a child on more than one occasion, then such person shall be punished with imprisonment for life, which shall mean imprisonment for the remainder of that person’s natural life, and shall also be liable to fine.
(7) When a public servant or a police officer is involved in the trafficking of any person then, such public servant or police officer shall be punished with imprisonment for life, which shall mean imprisonment for the remainder of that person’s natural life, and shall also be liable to fine.

भारताने 2012 च्या दिल्ली सामूहिक बलात्कार प्रकरणानंतर स्थापन झालेल्या 2013 च्या न्यायमूर्ती वर्मा समितीच्या अहवालाच्या प्रतिसादात मानव तस्करीविरोधी कायदा अधिक मजबूत केला. अहवालात विशेषतः स्त्रिया व बालकांची लैंगिक शोषण, जबरदस्तीचे मजुरीकाम आणि अवयव काढणे यांसाठी होणाऱ्या तस्करीच्या हाताळणीतील त्रुटी दाखवण्यात आल्या. 2013 च्या Criminal Law Amendment ने प्रथमच सर्वसमावेशक तस्करीचे प्रावधान सादर केले (Section 370 IPC), जे आधीच्या मुख्यत: वेश्या व्यवसायासाठीच्या तस्करीवर केंद्रित अरुंद तरतुदीला बदलून आले. Bharatiya Nyaya Sanhita, 2023 मध्ये हे प्रावधान Section 143 म्हणून पुढे नेले आहे; संरचना व उद्देश बहुतांशी जतन करून ते भारताच्या नव्या फौजदारी संहितेत पुन्हा क्रमांकित केले आहे.
न्यायालये याला कशी वाचतात
मागील तरतुदीखाली (Section 370 IPC) न्यायालयांनी सुसंगतरीत्या ठरवले की एकदा नमूद केलेल्या कोणत्याही साधनांचा (बल, फसवणूक, जबरदस्ती, सत्तेचा गैरवापर इ.) वापर दिसून आला की पीडिताची वरकरणी सहमती अप्रस्तुत ठरते — हे तत्व बाल लैंगिक अत्याचाराच्या कायद्यातील तत्वाशी सुसंगत आहे. न्यायालयांनी ‘शोषण’ ही व्याख्या व्यापक धरून बंधुआ मजुरी, जबरदस्तीच्या लग्नाशी जोडलेले शोषण, आणि संघटित भिक मागण्याच्या टोळ्या यांनाही यात धरले आहे, केवळ व्यावसायिक लैंगिक शोषणापुरतेच नाही. निर्णयांनी अधोरेखित केले आहे की तस्करी हा प्रक्रियाधारित गुन्हा आहे — प्रत्यक्ष शोषण होण्याआधीच, भरती किंवा वाहतूक टप्प्यावर गुन्हा पूर्ण होतो, कारण कायदा संपूर्ण तस्करी साखळीला दंडनीय ठरवतो जेणेकरून प्रत्येक दुव्यावर कारवाई प्रभावी करता येईल.
सामान्य गृहितके
धरण: पीडित किंवा त्यांच्या कुटुंबाने व्यवस्था मान्य केली असेल तर ते तस्करी ठरत नाही.
घटना: कायद्यात स्पष्ट केले आहे की पीडिताची संमती अप्रस्तुत आहे — बल, फसवणूक, जबरदस्ती किंवा प्रलोभन (उदा., देयक) देऊन ती संमती मिळवली असल्यास तस्करी तरीही सिद्ध होऊ शकते.
धरण: तस्करी म्हणजे फक्त कोणाला सीमेपार किंवा लांब अंतरावर हलवणे एवढेच असते.
घटना: हा कायदा शोषणासाठी व्यक्तीची भरती, वाहतूक, आसरा देणे, हस्तांतरण करणे, किंवा केवळ त्या व्यक्तीचा ताबा घेणे यांनाही कव्हर करतो — हे सर्व एकाच शहरात, अगदी एकाच इमारतीतही घडू शकते.
धरण: तस्करी म्हणजे फक्त लैंगिक शोषण एवढेच.
घटना: स्पष्टीकरण 1 मध्ये शोषणाची व्याख्या व्यापकपणे केली असून त्यात जबरदस्तीची मजुरी, गुलामगिरीसारख्या पद्धती, दास्यत्व, जबरदस्तीची भिक मागणे आणि जबरदस्तीने अवयव काढणे यांचा समावेश आहे; फक्त लैंगिक शोषणापुरते नाही.
