धारा 495
repealedSame offence with concealment of former marriage from person with whom subsequent marriage is contracted
Whoever commits the offence defined in the last preceding section having concealed from the person with whom the subsequent marriage is contracted, the fact of the former marriage, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.

यह प्रावधान मानता है कि सक्रिय गोपनीयता के साथ किया गया द्विविवाह अधिक गंभीर है, क्योंकि नया जीवनसाथी छल के कारण ऐसे विवाह में फंस जाता है, जिसे सत्य पता होने पर वह संभवतः स्वीकार न करता। धारा 494 के अंतर्गत साधारण द्विविवाह की तुलना में अधिकतम सज़ा बढ़ाकर, क़ानून अनभिज्ञ साथी के प्रति की गई जानबूझकर धोखाधड़ी के अतिरिक्त तत्व को दंडित करता है।
आम गलतफहमियाँ
मिथक: धारा 494 और धारा 495 अलग-अलग आचरणों को दंडित करती हैं।
तथ्य: धारा 495, धारा 494 वाले उसी द्विविवाह कृत्य को कवर करती है, पर उसमें गोपनीयता (concealment) का अतिरिक्त तत्व जुड़ता है; इसी कारण इसमें अधिकतम दंड अधिक रखा गया है।
