repealedExtortion by threat of accusation of an offence punishable with death or imprisonment for life, etc
Whoever commits extortion by putting any person in fear of an accusation against that person or any other, of having committed or attempted to commit any offence punishable with death, or with imprisonment for life, or with imprisonment for a term which may extend to ten years, or of having attempted to induce any other person to commit such offence, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine;

यह धारा जबरन वसूली के एक विशेष रूप से छलपूर्ण तरीके पर केन्द्रित है, जहाँ धमकी शारीरिक हिंसा की नहीं, बल्कि किसी व्यक्ति की प्रतिष्ठा या स्वतंत्रता को अत्यन्त गम्भीर अपराध के झूठे या अपयशजनक आरोप से नष्ट करने की होती है। क़ानून यह मानता है कि किसी निर्दोष को गम्भीर अपराधी के रूप में कलंकित किए जाने का भय, शारीरिक क्षति के भय जितना ही बाध्यकारी हो सकता है; इसलिए ऐसी जबरन वसूली को, गम्भीर चोट की धमकी देकर की गई जबरन वसूली जितनी ही कठोरता से दण्डित किया जाता है। इसी प्रकार का प्रावधान भारतीय दण्ड संहिता का स्थान लेने वाले Bharatiya Nyaya Sanhita, 2023 में भी जारी है, जो 2024 में लागू हुआ।
