धारा 276
repealedSale of drug as a different drug or preparation
Whoever knowingly sells, or offers or exposes for sale, or issues from a dispensary for medicinal purposes, any drug or medical preparation, as a different drug or medical preparation, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both.

रोगी और चिकित्सक दवाओं की सही पहचान पर निर्भर रहते हैं, क्योंकि गलत दवा—भले ही असली और मिलावटरहित हो—गलत बीमारी में दिए जाने पर बेअसर या ख़तरनाक हो सकती है। यह धारा मिलावट से अलग, जानबूझकर गलत लेबल लगाने या एक दवा को दूसरी के रूप में प्रस्तुत करने को दंडित करती है, क्योंकि यहाँ हानि दवा की सामग्री से छेड़छाड़ नहीं, बल्कि गलत पहचान से होती है। आधुनिक विनियमन अब मुख्यतः Drugs and Cosmetics Act, 1940 के अंतर्गत आता है। Bharatiya Nyaya Sanhita, 2023 द्वारा प्रतिस्थापित, प्रभावी 1 July 2024।
