Every High Court may, by general rule, prescribe the manner in which the evidence of witnesses and the examination of the accused shall be taken down in cases coming before it, and such evidence and examination shall be taken down in accordance with such rule. उच्च न्यायालये अनेकदा फौजदारी प्रकरणे खालच्या खटल्यांच्या न्यायालयांपेक्षा वेगळ्या पद्धतीने हाताळतात—उदा. अपीलांमध्ये किंवा त्यांच्या मूळ अधिकारक्षेत्रातील प्रकरणांमध्ये—म्हणूनच जुने CrPC मधील Section 283 या तरतुदीत प्रत्येक उच्च न्यायालयाला आपल्या कामकाजाच्या भार आणि प्रथेनुसार व्यवहार्य नोंद प्रक्रियेची आखणी करण्याची मुभा दिली आहे; सर्वत्र एकच कठोर साचा लादण्याऐवजी ही लवचिकता दिली आहे.
