अनुच्छेद 185
सभापतीस किंवा उपसभापतीस पदावरून दूर करण्याचा ठराव विचाराधीन असताना त्याने अध्यक्षस्थान न स्वीकारणे
सभापतीस किंवा उपसभापतीस पदावरून दूर करण्याचा ठराव विचाराधीन असताना त्याने अध्यक्षस्थान न स्वीकारणे.— (1) विधानपरिषदेच्या कोणत्याही बैठकीत, सभापतीस त्याच्या पदावरून दूर करण्याचा कोणताही ठराव विचाराधीन असताना, सभापती, अथवा उपसभापतीस त्याच्या पदावरून दूर करण्याचा कोणताही ठराव विचाराधीन असताना, उपसभापती, स्वत: उपस्थित असला तरी, अध्यक्षस्थान स्वीकारणार नाही आणि अनुच्छेद 184 च्या खंड (2) च्या तरतुदी, जशा त्या, सभापती, किंवा, यथास्थिति, उपसभापती अनुपस्थित असलेल्या बैठकीच्या संबंधात लागू होतात, तशाच त्या अशा प्रत्येक बैठकीच्या संबंधात लागू होतील. (2) सभापतीस त्याच्या पदावरून दूर करण्याचा कोणताही ठराव विधानपरिषदेत विचाराधीन असताना त्याला विधानपरिषदेमध्ये भाषण करण्याचा व तिच्या कामकाजात अन्यथा भाग घेण्याचा हक्क असेल, आणि अनुच्छेद 189 मध्ये काहीही असले तरी, असे कामकाज चालू असताना अशा ठरावावर किंवा अन्य कोणत्याही बाबीवर फक्त पहिल्याच फेरीत मतदान करण्यास हक्कदार असेल, परंतु समसमान मते पडल्यास, मतदान करण्यास हक्कदार असणार नाही.

This provision embodies a basic principle of natural justice: no one should judge or control proceedings that decide their own fate. If the Chairman or Deputy Chairman stayed in the chair while the House debated removing them, they could control debate time, choose who speaks, and influence the outcome unfairly. The framers borrowed this safeguard from British parliamentary practice and applied it symmetrically to the Speaker/Deputy Speaker of the Assembly (Article 181) and the Chairman/Deputy Chairman of the Council (Article 185), ensuring removal debates are conducted fairly by a neutral presiding member.
