धारा 239
Intentional omission to give information of offence by person bound to inform
Whoever, knowing or having reason to believe that an offence has been committed, intentionally omits to give any information respecting that offence which he is legally bound to give, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to five thousand rupees, or with both.

कुछ व्यक्तियों (जैसे जिन्हें अपराधों की सूचना देने का विशिष्ट वैधानिक दायित्व है) पर ज्ञात अपराधों की सूचना प्राधिकरणों को देने का क़ानूनी दायित्व होता है। यह प्रावधान, जो पहले Indian Penal Code, 1860 की Section 202 था, ऐसे कर्तव्य का जानबूझकर उल्लंघन करने पर दंड निर्धारित करता है, ताकि कानूनी रिपोर्टिंग दायित्वों को मनमाना न समझा जाए।
आम गलतफहमियाँ
मिथक: यह कहना गलत है कि अपराध के बारे में चुप रहना तभी दंडनीय है जब आप उसमें शामिल हों।
तथ्य: यदि आप किसी अपराध की रिपोर्ट करने के लिए क़ानूनन बाध्य हैं और जानबूझकर ऐसा नहीं करते, तो वही चुप्पी स्वयं एक दंडनीय अपराध है।
