Indian Penal Code, 1860
Section 355
repealedAssault or criminal force with intent to dishonour person, otherwise than on grave provocation
Whoever assaults or uses criminal force to any person, intending thereby to dishonour that person, otherwise than on grave and sudden provocation given by that person, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.
Why this exists
Beyond physical harm, the law recognises that certain assaults are meant to humiliate or dishonour a person, which carries its own social harm distinct from ordinary assault. This section addresses that specific intent, providing a somewhat higher punishment than plain assault under Section 352.
Common misconceptions
- Myth: This is the same as ordinary assault under Section 352.
Fact: This section requires a specific intent to dishonour the victim, which is treated somewhat more seriously than plain assault without that particular intent.
