Indian Penal Code, 1860
Section 468
repealedForgery for purpose of cheating
Whoever commits forgery, intending that the document or electronic record forged shall be used for the purpose of cheating, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
Why this exists
This section combines two wrongs -- forgery and the intent to cheat -- into one offence, so that people who fake documents as a tool for defrauding others face tougher punishment than someone who forges without that specific fraudulent purpose. It is frequently charged together with the general cheating provision. The IPC was repealed on 1 July 2024 and replaced by the Bharatiya Nyaya Sanhita, 2023, which now governs these offences.
Common misconceptions
- Myth: You must actually succeed in cheating someone for this section to apply.
Fact: It's the intention to use the forged document for cheating that matters -- the offence is complete even if the cheating attempt fails or is caught early.
