Section 462
repealedPunishment for same offence when committed by person entrusted with custody
Whoever, being entrusted with any closed receptacle which contains or which he believes to contain property without having authority to open the same, dishonestly, or with intent to commit mischief, breaks open or unfastens that receptacle, shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.
Why this exists
When someone is trusted to hold or guard a locked container without being allowed to open it, breaking that trust by forcing it open is worse than a stranger doing the same thing, because it involves a betrayal of the confidence placed in them. This section therefore raises the punishment above that in section 461 to reflect the added breach of trust.
