Section 459
repealedGrievous hurt caused whilst committing lurking house-trespass or house-breaking
Whoever, whilst committing lurking house-trespass or house-breaking, causes grievous hurt to any person or attempts to cause death or grievous hurt to any person, shall be punished with imprisonment for life, or imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
Why this exists
This section addresses the situation where a break-in turns violent in the moment, whether or not it was planned that way in advance. Because actual serious injury (or an attempt to kill or seriously injure) occurred during the intrusion, the law punishes this far more harshly than trespass or break-in alone, treating it almost like a violent crime committed in the course of a property offence.
