Section 456
repealedPunishment for lurking house-trespass or house-breaking by night
Whoever commits lurking house-trespass by night, or house-breaking by night, shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine.
Why this exists
This section raises the baseline punishment from section 453 specifically for offences committed at night, since darkness increases the danger to residents, who may be asleep and vulnerable, and reduces the likelihood of the intruder being seen or caught.
