Section 449
repealedHouse-trespass in order to commit offence punishable with death
Whoever commits house-trespass in order to the committing of any offence punishable with death, shall be punished with imprisonment for life, or with rigorous imprisonment for a term not exceeding ten years, and shall also be liable to fine.
Why this exists
This section increases the punishment for house-trespass sharply when it is a stepping stone toward an extremely grave crime, such as murder, since the trespass here is not an end in itself but preparation for the most serious kind of harm the law recognises. Linking the trespass punishment to the seriousness of the intended crime ensures the law reflects just how dangerous the intrusion really was.
