Indian Penal Code, 1860
Section 447
repealedPunishment for criminal trespass
Whoever commits criminal trespass shall be punished with imprisonment of either description for a term which may extend to three months, or with fine which may extend to five hundred rupees, or with both.
Why this exists
This section provides the baseline penalty for the basic form of criminal trespass defined earlier in the law, before the tougher, more specific punishments apply to trespass into homes or trespass done with more dangerous intentions. It reflects that simple trespass, while wrongful, is generally treated as a comparatively minor offence unless aggravating factors are present.
