Section 440
repealedMischief committed after preparation made for causing death or hurt
Whoever commits mischief, having made preparation for causing to any person death, or hurt, or wrongful restraint, or fear of death, or hurt, or of wrongful restraint, shall be punished with imprisonment of either description for a term which may extend to five years, and shall also be liable to fine.
Why this exists
Ordinary mischief is usually punished lightly, but this section recognises that damaging property can sometimes be a stepping stone or cover for a planned attack on a person, such as sabotaging a vehicle or blocking an exit before assaulting someone. Because the property damage here is linked to a more sinister purpose against a person, it is punished more severely than simple mischief.
