Assisting in concealment of stolen property

Why this exists

Thieves often need help hiding or getting rid of stolen goods to avoid detection, and this section targets people who provide that assistance even if they did not steal the property themselves or directly receive it. It closes a gap left by the offence of merely receiving stolen property, capturing those who assist in other ways, such as helping conceal or destroy evidence of theft. Under the Bharatiya Nyaya Sanhita, 2023, this corresponds to Section 317(5).

How courts read it

Courts distinguish this offence from receiving stolen property under Section 411, since here the accused need not actually receive or possess the property; it is enough that they voluntarily assisted in concealing, disposing of, or making away with it, while knowing or having reason to believe it was stolen.
