Section 341
repealedPunishment for wrongful restraint
Whoever wrongfully restrains any person shall be punished with simple imprisonment for a term which may extend to one month, or with fine which may extend to five hundred rupees, or with both.
Why this exists
Having defined wrongful restraint in Section 339, this section fixes a relatively modest punishment, reflecting that restraint, unlike full confinement, is a lesser interference with personal liberty since the person usually has another way to proceed.
Common misconceptions
- Myth: Blocking someone briefly is not a real crime.
Fact: Even a short or seemingly minor act of blocking someone's rightful path can attract punishment under this section.
