Indian Penal Code, 1860
Section 336
repealedAct endangering life or personal safety of others
Whoever does any act so rashly or negligently as to endanger human life or the personal safety others, shall be punished with imprisonment of either description for a term which may extend to three months or with fine which may extend to two hundred and fifty rupees, or with both.
Why this exists
The law does not wait for someone to actually get hurt before stepping in; reckless behaviour that could easily have caused injury or death is punished to deter dangerous conduct before tragedy occurs. This covers things like careless handling of dangerous machinery, reckless driving without an accident, or firing a gun carelessly in a crowd.
Common misconceptions
- Myth: You can only be punished if someone is actually injured.
Fact: This section punishes the dangerous, reckless act itself, regardless of whether anyone was actually hurt.
