Section 334
repealedVoluntarily causing hurt on provocation
Whoever voluntarily causes hurt on grave and sudden provocation, if he neither intends nor knows himself to be likely to cause hurt to any person other than the person who gave the provocation, shall be punished with imprisonment of either description for a term which may extend to one month, or with fine which may extend to five hundred rupees, or with both.
Why this exists
The law recognises that people are not always fully in control when provoked suddenly and severely. Rather than treating such reactions the same as cold, calculated violence, this section allows a much lighter punishment, provided the reaction was aimed only at the provoker and not bystanders.
Common misconceptions
- Myth: Provocation is a complete excuse and the person walks free.
Fact: It only reduces the punishment; hurting someone is still a punishable offence, just a lesser one, and only if the provoked person alone was hurt.
