Section 289
repealedNegligent conduct with respect to animal
Whoever knowingly or negligently omits to take such order with any animal in his possession as is sufficient to guard against any probable danger to human life, or any probable danger of grievous hurt from such animal, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both.
Why this exists
Animals such as dogs, bulls, or other livestock can cause serious harm if left unrestrained, especially in public or residential areas. This section holds an animal's keeper criminally responsible for failing to take reasonable precautions, such as proper chaining, fencing, or muzzling, once the danger is known. Under the Bharatiya Nyaya Sanhita, 2023, this offence continues under a renumbered section.
