Section 265
repealedFraudulent use of false weight or measure
Whoever, fraudulently uses any false weight or false measure of length or capacity, or fraudulently uses any weight or any measure of length or capacity as a different weight or measure from what it is, shall be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both.
Why this exists
This section covers false weights and measures themselves (like a 'one kilogram' weight that is actually lighter), separately from false weighing instruments. It also covers using a correct weight dishonestly, for instance calling a half-kilogram weight a full kilogram, closing a loophole where the tool itself might be genuine but is used to deceive. Modern regulation of weights and measures now mostly falls under the Legal Metrology Act, 2009. The IPC has been replaced by the Bharatiya Nyaya Sanhita, 2023, effective 1 July 2024.
