Reference to High Court

Why this exists

Lower courts are not supposed to independently strike down laws as invalid; that authority belongs to the High Courts and the Supreme Court under the Constitution. This provision creates an orderly channel for a trial court that suspects a law is unconstitutional or otherwise invalid to get an authoritative ruling before proceeding, ensuring consistency and respecting the judicial hierarchy. It corresponds to section 395 of the former CrPC.
