Bharatiya Nagarik Suraksha Sanhita, 2023
Section 411
Procedure in case of difference of opinion
Where any such case is heard before a Bench of Judges and such Judges are equally divided in opinion, the case shall be decided in the manner provided by section 433.
Why this exists
Judicial benches can sometimes split evenly, especially with two-judge benches, and the law needs a clear mechanism to resolve such deadlocks rather than leaving a death sentence case in limbo. Rather than duplicating the rule here, this section simply points to the general procedure for resolving divided opinions found in section 433. It continues section 370 of the CrPC, 1973.
