Section 364

Procedure when Magistrate cannot pass sentence sufficiently severe

Why this exists

Different magistrates have different limits on the sentences they can impose. This provision ensures that when a case genuinely deserves harsher punishment than the trying magistrate is empowered to give, it moves up to a magistrate with adequate sentencing power, rather than the accused receiving an inadequate sentence simply because of which magistrate happened to hear the case.
