Section 273

Compensation for accusation without reasonable cause

Why this exists

This is a deterrent against reckless or malicious accusations - it lets courts compensate people who were dragged through discharge or acquittal proceedings on baseless complaints, with a real enforcement teeth (possible imprisonment for non-payment) rather than a purely symbolic remedy. It mirrors section 250 of the earlier Code of Criminal Procedure.

  • Myth: Only the person who filed a formal complaint in court can be made to pay compensation under this rule.
    Fact: This also covers someone who merely gave information to the police or a Magistrate that led to the accusation, not just formal complainants.
