Section 266

Evidence for defence

Why this exists

This guarantees the accused a real opportunity to mount a defence in a Magistrate-tried warrant case, balanced against safeguards preventing abuse of that right to harass witnesses or stall the trial, and it allows costs of attendance to be secured in advance so witnesses aren't left out of pocket. It mirrors section 243 of the earlier Code of Criminal Procedure.
