Section 252
Conviction on plea of guilty
If the accused pleads guilty, the Judge shall record the plea and may, in his discretion, convict him thereon.
Why this exists
Guilty pleas save court time and resources by avoiding a full trial when the accused himself admits the offence. But because Sessions trials usually involve serious crimes, the law gives the judge discretion rather than an automatic conviction - the judge can still insist on evidence if the plea seems unsafe, ambiguous, or not genuinely voluntary. This mirrors section 229 of the earlier Code of Criminal Procedure.
Common misconceptions
- Myth: If you plead guilty, the judge must convict you immediately.
Fact: The judge has discretion - conviction on a guilty plea is optional, not automatic.
