Mischief

Why this exists

Property damage disrupts people's lives, livelihoods, and security just as much as theft does, sometimes more severely because destroyed property cannot simply be returned. This section defines the offence of mischief broadly and then scales the punishment to the actual monetary harm caused, ensuring that small acts of vandalism and large-scale destructive sabotage are treated proportionately.

Common misconceptions
  • Myth: Mischief only applies if you damage a stranger's property, not something you partly own.
    Fact: The law says mischief can happen even if you own the property yourself or jointly with someone else, as long as you cause wrongful loss to another person by damaging it.
