Section 309

Robbery

Why this exists

Robbery combines the property-crime elements of theft or extortion with an added element of immediate violence or intimidation, making it more dangerous to victims than either offence alone. The heavier punishment for highway robbery at night, and for causing hurt during the act, reflects the greater risk and vulnerability victims face in those situations.

How courts read it

Courts distinguish robbery from simple theft or extortion by requiring that the fear or violence be of something instant — happening right then and there — and, for extortion-based robbery, that the offender actually be present with the victim at the time.

Common misconceptions
  • Myth: Robbery and theft are legally the same crime with different names.
    Fact: Robbery is a specifically aggravated form of theft or extortion, requiring the offender to cause or threaten instant death, hurt, or restraint, which is not required for simple theft.
