Bharatiya Nyaya Sanhita, 2023
Section 300
Disturbing religious assembly
Whoever voluntarily causes disturbance to any assembly lawfully engaged in the performance of religious worship, or religious ceremonies, shall be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both.
Why this exists
This section protects people's right to peacefully practice their religion without deliberate interference, recognising that religious gatherings deserve legal protection from intentional disruption.
Common misconceptions
- Myth: Only physically stopping a ceremony counts as 'disturbing' it under this law.
Fact: Any voluntary act that disturbs a lawful religious assembly — including loud noise or provocation meant to disrupt it — can fall under this section, not just physical interference.
