Why this exists

This provision, earlier Section 216 of the Indian Penal Code, 1860, punishes helping an escaped prisoner or a person under a lawful arrest order stay hidden from the authorities, recognizing that such sheltering directly undermines the enforcement of custody and arrest orders. As with the general harbouring provision, it carves out spouses from liability.

Common misconceptions
  • Myth: Helping any relative avoid arrest is protected by law, not just a spouse.
    Fact: The spousal exception is narrow - it applies only to husbands and wives, not to other relatives like cousins, siblings, or parents, who can still be prosecuted for sheltering an escapee.
