Power of Parliament to legislate with respect to any matter in the State List if a Proclamation of Emergency is in operation

Why this exists

India's Constitution normally divides lawmaking power between Parliament and state legislatures through the Union, State, and Concurrent Lists. But the Constitution's framers anticipated crises — war, external aggression, or armed rebellion — where quick, uniform national action might be needed even on subjects usually left to the states (like public order or agriculture). Article 250 lets Parliament temporarily step into that space during a Proclamation of Emergency, ensuring the country can respond as one unit. The six-month sunset clause in clause (2) was added to prevent this emergency power from becoming a permanent erosion of federalism once the crisis passes.

How courts read it

Courts have generally treated Article 250 as part of the broader emergency scheme (Articles 352-360), reading it alongside the Supreme Court's landmark ruling in Minerva Mills v. Union of India (1980), which emphasized that emergency powers must remain temporary and subject to judicial and political checks, not tools for permanent centralization. Courts have not needed to interpret Article 250 extensively in isolation, since actual invocations have been rare and short-lived, but its logic has been discussed as an example of the Constitution's 'flexible federalism' that tilts toward the Centre only in genuine crises.

Common misconceptions
  • Myth: Laws made by Parliament under Article 250 during an Emergency last forever.
    Fact: Clause (2) makes clear that laws Parliament could only make because of the Emergency automatically expire six months after the Emergency ends, unless re-enacted through Parliament's normal powers.
  • Myth: Article 250 lets Parliament permanently take over State List subjects.
    Fact: The power only exists 'while a Proclamation of Emergency is in operation' — it is temporary and tied strictly to the Emergency's duration.
